His career is defined by extensive service within the American legal system. He later worked as an Assistant United States Attorney for the Eastern District of Washington until 1972.

In 1995, President Bill Clinton nominated Whaley to the United States District Court for the Eastern District of Washington. After being confirmed by the United States Senate, he served as chief judge of the District starting in 2005, eventually assuming senior status on July 12, 2009.
